Contract of sale

Summary

Tapia sells to Kyriakos for 5 solidi her half-share of a house situated in the southern part of the fortress on the street of the public camel yard (lines 22-23). She had previously purchased the house jointly with her husband from Ioannes, also known as Paptsios.The half-share comprises two roof-terraces (lines 29-30), a halfshare of all related appurtenances, including the vestibule, gateway, stair, courtyard, and oven, (lines 19-20 and 30- 31), and three rooms, one on each floor: one on the st floor, together with the recess under the stair (lines 25, 27); a living room on the 2nd floor (lines 26-27); another living room on the 3rd floor (line 28). Die andere Hälfte gehörte ihrem verstorbenen Manne Jakobos. ... . - Rekto 81 Zeilen, verso 2 Zeilen. - Schrift: Die Schrift ist eine ungewöhnlich große, ziemlich senkrecht gestelle Minuskelkursive. Der Schreiber liebt beträchtliche, übrigens gleichmäßig große Zwischenräume zwischen den Zeilen und lässt rechts und links einen Rand von 3 cm frei, gleiche Zeilenlänge wird öfter durch Schnörkel erstrebt. Die Orthographie zeigt eine Reihe von Nachlässigkeiten, auch grammatische Fehler sind nicht selten. Die Syntax ist zuweilen recht unbeholfen, Einfluss der Vulgärsprache in mehreren Einzelheiten zu bemerken. Der Aussteller der Urkunde ist nicht mit dem Schreiber identisch. Als Kyriakos später die Hausanteile wieder verkaufte, diente diese Urkunde als Vorlage für die neue Verkaufsurkunde Mon. 12 und wurde großenteils einfach kopiert.

1	† In the reign of our most divine master Flavius Maurice Tiberius, the eternal
2	Augustus, Emperor, and greatest benefactor, in the fifth year, and in the consulship of the same
3	master of ours, in the third year, on Phaophi tenth, in the fifth indiction, in Syene.
4	† Aurelia Tapia daughter of Tsios, whose mother is Mariam, acting without her husband as guardian,
5	originating from Syene and providing a signatory below
6	signing on her behalf and witnesses below, according to her instruction,
7	bearing additional witness to this written and warranted deed of sale †, to Flavius Kyriakos
8	son of Menas, soldier, caballarius of the regiment of Syene, greetings. I, the aforesaid
9	Tapia, acknowledge by this, my written deed of sale, willingly and convinced
10	without any guile or fear or force or deception or compulsion or deceit
11	or flattery or contrivance or any malice or maliciousness or
12	baseness or any defect, (space) but of my own free will and guileless resolve
13	and clear conscience and sound understanding, according to this single
14	written security, that I have sold to you today and transferred, by the
15	law of sale and for eternal possession and with every most complete
16	right of ownership, the entire half-share belonging to me of a house, in the condition it is in,
17	from foundation to air, the other half-share of which belonged to lakobos,
18	my departed husband. Moreover, I have sold to you also
19	the half-shares belonging to me of all the appurtenances, (consisting) of the vestibule, and gateway,
20	and stair, and courtyard, and oven, positively in accordance with the formerly done
21	deed of sale in my name and that of my late husband lakobos,
22	the same house lying in Syene in the southern part of the fortress and
23	in the Quarter of the Public Camel Yard of the transport (service) from Philae and of the house of
24	Abraamios son of Pachymios. The boundaries of the entire house of which I have sold you the very
25	halfshare belonging to me — (consisting) of the room on the first floor, facing north
26	toward the public road; and above it a living room on the second floor, facing
27	west toward the landing of the stair; and the (recess) under the stair, namely, (the) chrere, on the first floor;
28	and the southern living room on the third floor, facing north toward the common
29	courtyard; and the roof terrace above it, up to the air; and the eastern large
30	terrace, up to the air; and a half(-share) of all the appurtenances, from base
31	to air — on the south, the blind and narrow road and the house of Abraamios son of Pachymios; on the
32	north, the public road; on the east, the house of Abraamios son of Pachymios; on the west,
33	the house of Allamon son of Patechnoumios; or whatever may be the boundaries, everywhere on every side,
34	just as I have asserted orally. And nothing at all has been left unsold by me
35	of the above-cited halfshare of a house and all its
36	appurtenances, from base to air, (space) having come around to me through rightful
37	purchase from Ioannes, also (called) Paptsios, and to him through parental succession,
38	in accordance with the power of the old deed of sale, (space) the price mutually
39	agreed upon and approved being in capital of genuine gold,
40	five solidi in the weight of Syene, i.e., gold, 5 solidi in the weight of Syene, which full and adequate
41	price I have here received in full from you, Kyriakos, the purchaser, from (your) hand
42	to my hand, from your cashbox, in Syene, in number and weight complete,
43	on the present day. And I warrant to you the deed of sale with every warranty always
44	against anyone who intends to bring suit against you or contend (about it). The man who intends to bring suit against you
45	or contend (about it) — (him) I, the seller, shall drive out and cleanse (the deed of sale) for you
46	at my own expense and cost according to the law of sale and warranty
47	in order that you, Flavius Kyriakos, the buyer, hereafter (may)
48	control and own and administer and manage and build
49	and sell and give and resell and exchange, and leave (it) to your children and
50	descendants and do everything concerning it and act without let
51	or hindrance, and in order that I may not sue you — nor shall I sue — nor may anyone else in
52	my name, now or on any occasion, in any way, on
53	any pretext. None of my heirs or children or descendants
54	or those closest to my family, on my father's or mother's (side), will be able to
55	bring action against you or sue (you) or initiate arbitration against you on account of this case.
56	And it shall not avail the man who presumes to sue you or contend with you or violate or undermine
57	this deed of sale, but he shall provide, as penalty
58	for the violation, double the aforesaid price, and nothing (shall) prevail
59	against what is written herein in this deed of sale, but besides he (shall) unwillingly
60	abide by it as if it had been done in a public archive,
61	because by me it had been thus decided, compulsion or force or deception or any guile not being present,
62	to have sold to you the aforementioned half-share of a house and
63	half(-shares) of the related appurtenances, and I have received from you

66	warranted and unbreakable and unshakable and lawful wherever brought forward
