Summary

Tapia here sells again two of the same shares of rooms she had sold almost nine years earlier to her daughter, Kako, and to Kako's husband, Patermouthis (P. Munch. 9.30-35). These are a half-share in a second-floor living room (lines 17-18) and a quarter-share of a fourth-floor roof-terrace (lines 19-21). (These rooms had made up only a part of the earlier transaction, which also included shares of altogether different houses.) It is clear from lines 52-53 that she retained ownership of a quarter-share of the terrace. The mystery here is how Tapia can sell again something she had already sold. One may imagine that Patermouthis and Kako, after P. Munch. 9, sold (or gave) these two room-shares back to her. But, to explain the presence of this document (P. Lond. V 1733) in our archive, we must assume that, at some later date, Patermouthis and Kako regained ownership.

1	† In the name of the lord and master Jesus Christ, our god and savior,
2	in the reign of our most divine master Flavius Maurice Tiberius,
3	the eternal Augustus and emperor, in the twelfth year and in the eleventh year of the consulship
4	of his serenity, on Phamenoth 10, in the 12th indiction,

6	☧ Aurelia Tapia daughter of Tsios, her mother being Mariam, a widow,
7	originating from Syene, and providing a signatory below, the one
8	signing on her behalf, And witnesses bearing witness below to this warranted
9	and lawful deed of sale, to Flavius Apa Dios son of Sourous, soldier
10	of the regiment of Syene, greetings. I, the aforesaid Tapia, acknowledge
11	by this, my written security, willingly and convinced
12	without any guile or fear or force or deception or compulsion or
13	deceit, and apart from any sort of malice or maliciousness or
14	any mean intention, but of my own free and unalterable will
15	and with guileless resolve and clear conscience according to this
16	single written security, that I have sold to you today and transferred,
17	from now, forever, and for all time to come, the
18	half-share belonging to me and falling to me of the living room on the second floor;
19	and the quarter-share of the roof-terrace above the bedroom which is
20	above the living room which belongs jointly to me and my siblings
21	Menas and Tselet; and my share of all the appurtenances, consisting of
22	the vestibule and gateway and stair and gallery and
23	little oven, with entrance and exit and passage up and passage down, the same house
24	lying in the same Syene in the southern part of the fortress
25	and in the Quarter of Saint Apa Victor, triumphant martyr.
26	The same half-share of the living room and the quarter-share
27	of the terrace came to me in this way: one quarter-share of the living room
28	and the eighth-share of the terrace from a legacy from my mother Mariam,
29	and the other quarter-share and the eighth-share of the above-named
30	places just as has been said above from a rightful purchase through a written security
31	of purchase from Georgios, my brother, those that came
32	to me and to my siblings Menas and Tselet in common and undivided.
33	And they came to the aforesaid Mariam herself through a rightful legacy
34	from her parents, Papnouthios and Thekla, according to the meaning of
35	their will. The boundaries of the entire house are: on the south the house of Thekla
36	and Dios son of Kelolios; on the north the site of the shrine of the martyr Apa Victor,
37	onto which site the house's main door faces from the alley, beyond which is the site
38	of the same shrine; on the west the courtyard of Gounthos son of Makarios; on the east
39	the site of the same shrine of Apa Victor; or whatever the boundaries may be everywhere
40	on every side just as I have asserted. And nothing
41	of the same half-share of the living room
42	on the second floor facing north toward the landing of the stair,
43	and the quarter-share of the terrace up to the air, with a share
44	of all the appurtenances in proportion to my share, has been left unsold by me, the price
45	mutually agreed upon and approved being gold,
46	three solidi in the weight of Syene, i.e., gold, 3 solidi in the weight of Syene, which full price I have here
47	received in full from you, I the seller from you the purchaser, from your
48	hand to my hand, from your cashbox, in number and weight complete, investiture in order
49	that you, hereafter, the purchaser, may control and own the above - named
50	half-share of the living room, even the undivided one
51	on the second floor, and the quarter-share of the terrace up to the
52	air with all the appurtenances, together with our other joint owners,
53	and administer and manage it and build
54	and sell and give and bequeath it to your children and descendants
55	in any way you choose without let or hindrance, and in order that I may not sue you —
56	nor shall I sue — nor may anyone else in my name,
57	on any occasion, in any way, on any pretext
58	because, as I said before, I have received from you the
59	aforesaid price in full. The man who intends to sue you or contend
60	about the above-cited half-share of the living room
