Ἰωάννου
στρατιώτου ἀρίθ(μου) -?-
|
|
1 | | † XMG † |
2 | | † In the reign of our most divine master Flavius
Tiberius |
3 | | Mauricius, the eternal Augustus,
Emperor, in the first year |
4 | | on Payni
twenty-ninth, in the second indiction, in Antinoo-|
5 | | polis the most illustrious †. |
6 | | This settlement is drawn up and made |
7 | | mutually, executed (by both parties) willingly and
convinced, without any deception |
8 | | or force,
(space) by, on the one side, (space) Aurelius Ioannes |
9 | | son of Iakybis, his mother being Tapia, soldier of the
regiment of Syene, |
10 | | and on the other, (space)
Aurelius Patermouthis son of Menas, his mother being |
11 | | Tsia , boatman from the same city of the Syenians,
speaking |
12 | | and acting validly and settling on his
own |
13 | | authority both on his own behalf and on
behalf of Kako the most generous, |
14 | | who is on the
one hand his spouse and on the other the sister of the aforesaid Ioannes, |
15 | | both parties at present staying here in the
city of the Antinoeans. |
16 | | And it is agreed as set
forth below. (space) Iakybis, now of blessed |
17 | | memory, father of the aforesaid Ioannes |
18 | | and
father-in-law of the mentioned Patermouthius, |
19 | | left his life to Ioannes and Kako, the |
20 | | aforesaid, his children and heirs. (space) And after |
21 | | his death they divided among themselves all that was
|
22 | | left to them, every sort of thing from the
valuable to |
23 | | the most humble item, in
half-shares except for the securities |
24 | | of
different people who owed to their late |
25 | | father;
and, with respect to those, they decided that the same securities |
26 | | should be joint until the exaction in full and that
the |
27 | | money realized from them be divided between
themselves |
28 | | in half-shares. (space) These
matters having been thus arranged, |
29 | | the
aforesaid Ioannes brought an action against the aforesaid |
30 | | Patermouthis about a share of a house which came
around to him (Patermouthis) |
31 | | by right of
purchase from Isakos and Tsone, (space) and further |
32 | | also about a half-share of a boat purchased from
Iakybis, |
33 | | his late father-in-law. (space) And
after much had been said |
34 | | between them about
this, finally, through the mediation of some friends, |
35 | | they decided that Ioannes should have a quarter-share
of the |
36 | | purchased half-share of the same boat,
and |
37 | | that he should also have as well, because
of his legacy from his father, |
38 | | a quarter-share,
(space) while Patermouthis and Kako (space) |
39 | | have the other half-share of the same boat (space) and, in addition, the
entire |
40 | | share of a house purchased from them in
accordance with the power of its deed of sale. And since |
41 | | holding to such a mediation, namely, a reconciliation,
was approved by each |
42 | | party, (space) it was
logically necessary that there be (made) for them the present |
43 | | general and comprehensive settlement (space) by which
they acknowledge — and so acknowledges |
44 | | each
party: (space) first, that they have gotten and have received |
45 | | in its entirety everything that has fallen to each
party's lot of the legacy |
46 | | of the late Iakybis
and of the same boat and of the same house |
47 | | in
accordance with the statement above; secondly, that |
48 | | neither party has nor will have any claim against the
other with reference to the (estate) left |
49 | | by
the same late Iakybis, nor (with reference to) the same boat and the |
50 | | share of the house because each party has fully
satisfied |
51 | | the other party. (space) And it was
decided that the aforesaid |
52 | | Ioannes, immediately
on his return to his city, should deliver |
53 | | to
the aforesaid Patermouthis the deed of sale which had come from him
(Patermouthis) |
54 | | to the same Iakybis, of the
share of the same house. At any rate, |
55 | | it is
invalid and out-of-date and without strength whether it |
56 | | is brought forward by the same Iakybis or by any other
person at all whatsoever. |
57 | | And in the future
they may not sue and shall not sue each other ever, not |
58 | | by themselves nor by their heirs or successors or
assigns, |
59 | | not through an agent nor through any
intermediary person whatsoever, neither in |
60 | | (local) court or foreign nor out of court concerning this |
61 | | case or any other issue whatsoever, monetary and |
62 | | involving a complaint. (space) And, |
63 | | both parties have sworn that they will preserve all
the aforesaid (agreements), by the Holy |
64 | | and
Consubstantial Trinity and by the victory and permanence of |
65 | | our most pious master Flavius Tiberius Mauricius, |
66 | | the eternal Augustus, Emperor. (space) If |
67 | | either party attempts to violate in any way
whatsoever all that is written herein |
68 | | and
contravene it, he shall not profit |
69 | | from the
attempt at violation, (space) and the violating |
70 | | party acknowledges (that he must) offer in requital to the party abiding by
(the settlement) gold, |
71 | | twelve solidi to be
exacted by judgment and authority, |
72 | | with this
settlement being always strong even so. |
73 | | The
same Ioannes is not empowered to bring action against the same Patermouthis |
74 | | concerning the golden necklace of his
(Patermouthis') daughter Helen, |
75 | | but he holds
this by right of ownership for all time. |
76 | | I, the
aforesaid Patermouthis, acknowledge further, |
77 | | speaking and acting validly both for myself and for Kako |
78 | | my own spouse, that I am ready, at my own risk and by
means |
79 | | of every kind of property of mine, to
cause my own |
80 | | wife (space) to embrace and abide
in perpetuity by the authority |
81 | | of the present
settlements and to undermine no (part) |
82 | | of them
at all. (space) And, with reference to all the aforesaid |
83 | | and with reference to each part and the sum of them,
|
84 | | having been questioned, that they hold this
as so, to bestow, to do, to preserve, |
85 | | to
fulfill, to abide by, they have acknowledged †. (2nd hand) ††† (3rd hand) sign
of Ioannes, soldier of the regiment of Syene †. I, Aurelius |
86 | | Ioannes son of Iakybis, soldier of the regiment of
Syene, the aforesaid, have had |
87 | | this settlement
drawn up and am convinced by all that is written herein, |
88 | | subject to the aforementioned penalty, having sworn
also the divine oath as aforementioned, |
89 | | and I
have executed the deed. † I, Christopher son of Victor, assistant from
Antinoopolis, having been asked, wrote |
