Summary of Content Patermouthis and Kako (here spelled Tkako) draw up their will. Patermouthis, at least, lives another 30 years (P. Lond. V 1737 [D51]). Here they assign all the property of the one who dies first to the survivor, and upon the death of the survivor, to their common children in equal shares. The survivor is to enjoy the income and must settle the debts of the deceased. Any one of the children who contests the will is prohibited from benefiting from it and incurs a monetary penalty of 12 solidi. This will is written in the same year as P. Lond. V 1729 (D37), drawn up by the same scribe, and four of its five witnesses are identical with four of the five witnesses in P. Lond. V 1729.48-51 (D37), who sign in the same sequence. The two testaments were most likely drawn up at the same time, that is, 12 March, 584.

8 instruction and commission and request,
9greetings. Inasmuch as we have been joined to each other in the shared state of matrimony,
10providing no casual repose and cherishment
11for each other, providing repose and cherishing and serving
12and obeying and submitting, in absolutely no matter
13criticizing unfairly but living in all submissiveness, therefore we, being prudent
14lest, contrary to our expectation, one of us,
15having come to the end of his life and of the things of this world,
16withdraws from affairs, and lest the survivor should find himself in want
17because of the children of the two of us, considering the matter,
18pondering our calculations, having strong understanding,
19unimpaired minds, healthy senses, walking on foot
20at market, come forward to this
21written acknowledgment whereby we the afore
22said acknowledge, willingly and convinced apart from any
23guile or fear or force or deception or compulsion or deceit
24or flattery or contrivance or maliciousness or
25any defect, after deliberating twice and thrice, that — while we wish that we, surviving
26and well, may enjoy all our property and use it
27with whatever administration we wish, still,
28whenever it occurs to the master of the universe, Christ,
29may it not happen!, that one of us should come to the end of life — we acknowledge that the survivor
30shall have and be in possession of all the property left
31by the deceased — that which came around to him
32by parental succession and by right of purchase and by sweat and
33toil, among them being houses and objects of gold and silver and copper and
34mountain-copper and clothing and woven things and all sorts of minor
35items, from the large item to the most humble, and
36shall control these and own and administer and treat and repair them
37and from them feed and clothe himself and bury and attend to
38the funeral services of the dead one. None of
39our children is able or shall be able to bring suit against the survivor
40or sue or call him to account or hinder him until his death, and
41after his death I acknowledge that all the property that will be left by us
41will be conveyed to our common children in equal lots,
43and that no difference is made between the children, and that if
44the deceased should be seen to be owing or being owed to, I acknowledge that the survivor shall
45perform all giving and receiving for him the deceased until his own death, and
46after his death all contracted payments shall pass to
47our common children. But if one of our children
48or someone else should bring suit against the survivor to set aside or to violate
49or to undermine this mutual acknowledgment of ours
50or to initiate arbitration, I acknowledge that the one who intends to bring suit against the survivor, first, shall be entirely deprived
51and without portion of any asset inheritable by the
52one who attempts to violate this acknowledgment, and, in the second place, he shall recognize that he must pay as penalty
53gold, twelve solidi, to be exacted by judgment and authority from the
54assets of the violator, and in addition, nothing shall prevail against
55what is written herein but it shall be strong in every particular.
56And to all this we have sworn the divine and awesome
57oath by Almighty God and by the victory and permanence of our most serene
58masters not to violate the above-cited terms.
59And as our security we have presented this mutual acknowledgment,
60which is valid and warranted and lawful wherever brought forward, with the
61signature of the one signing on our behalf and of those witnessing below. And

66of Syene, having been asked, wrote on their behalf, they being present and having told it to me,
